CLIENT'S RIGHTS

1. No person, on the grounds of race, color, sex or national origin, will be denied benefits or be subjected to discrimination.

2. Each person shall be informed of the reason for admission and his or her rights, privileges and responsibilities. If the individual is a minor, adjudicated incompetent, or determined to be unable to understand fully his or her rights, then all rights and responsibilities devolve to the person's parent or guardian.

3. All available services, policies and procedures are to be made accessible to person served and, if applicable, to the legal representative of person.

4. Persons served may exercise their views, grievances, and opinions without having to fear interference or discrimination. This includes the right to respond either verbally or in writing to any incident or restraint report that they are involved in.

5. All persons served shall have the right to the least restrictive interventions and/or settings appropriate to their needs and abilities.

6. The person served has the right to the best care and treatment the facility has to offer. To the extent permitted by law, the individual will have the right to refuse treatment, and to be told of the resulting consequences.

7. All persons served have the right to be treated with respect, full recognition of his or her dignity and individuality, including privacy, treatment, and care of his or her personal needs.

8. All persons served shall exercise all civil rights afforded them by the Constitution of the United States and the State of Texas, including, but not necessarily limited, to the right to register to vote, to vote, to contract, to make a will, to marry, to sue, and to obtain a driver's license.

9. The persons served shall be informed of his or her right to participate in planning and decision-making processes, and his or her privileges, restrictions, and responsibilities.

10. The individual has the right to information about his or her condition, treatment, and progress. If the individual served is unable to make decisions, the person legally authorized to act for the person may receive a report on diagnosis, treatment and progress. The facility shall fully inform the individual and/or parent or guardian of the person's health and medical condition, unless contradicted for programmatic purposes (documented in the individual?s record).

11. The person served shall maintain the right to participate in social, religious, and
community groups at their own discretion, unless contraindicated by reasons documented in their record.

12. The individual shall have the right to communicate, associate, and meet privately with persons of choice, unless it is determined by team action and documented in their record, that this would infringe upon the rights of others or is programmatically contraindicated.

13. Unless prohibited in the written plan of treatment by team action, the person served will have the right to receive visitors and make home visits in accordance with BAC policies and procedures, to make phone calls to persons outside the facility, and to send and receive sealed and uncensored mail.

14. All persons served have the right to be free from mistreatment, neglect, and abuse.

15. The persons served have the right to receive a prompt, comprehensive diagnosis and evaluation adapted to his/her cultural background, language, and ethnic origin. Results of the diagnostic assessment must be written and recommendations must be made for needed services.

16. The individual has the right to be told the reason for admission, and the plans that will be carried out to help the person succeed. The facility will have written policies and procedures, which shall be available to staff, persons served, and their families, and public governing all areas of service. The type of population to be served shall be clearly defined, and only those persons whose needs can be met by the facility directly or in cooperation with other services will be accepted.

17. The person has a right to a written treatment plan, which will include the statement of long and short-term objectives, a behaviorally specific description of the activities, and a delineation of those individuals in the facility responsible for assisting the persons served in attaining the specific objectives.

18. The person served has the right to be assured that the plan of care is reviewed, progress measured, with modifications to objectives and programs occurring as necessary. A review of progress toward attainment of objectives shall occur no less than quarterly.

19. The person served has the right to know the names and qualifications of the treatment team.

20. The individual, and/or parents or guardian, shall have the right to refuse treatment and to withdraw from services entered into voluntarily.

21. The person served and any authorized representative, have the right to be informed of the individual's progress at periodic intervals during treatment, and to participate in the planning, development, and modifications of the person's individual treatment plan.

22. All persons served have the right to prompt, adequate and necessary medical and dental care, and treatment for physical and mental ailments. In most cases, the expense for treatment and medication is the responsibility of the individual, parent, or guardian.

23. The person served has the right to privacy concerning care and treatment. The person served has the right to know that, with certain exceptions, their personal records are treated as confidential by the facility.

24. All persons served have the right and must be informed that treatment information will be maintained confidentially in written records or in an automated data bank, and that written consent, or that of the guardian shall be required for the release of information to persons not otherwise authorized under the law to receive it. Records and policies and procedures regarding confidentiality will be maintained in the Bayes Achievement Center administrative offices.

25. The persons served shall be protected from physical and mental abuse, including abuse and discipline by other persons served at the facility.

26. BAC recognizes the right of the individual to manage personal financial affairs to the full extent of their capabilities. The facility will assist the individual in management of personal financial affairs when so authorized by the parent/guardian.

27. It is recognized that BAC has the responsibility of assisting each individual in the receipt of all financial benefits to which that person is entitled. The staff of BAC will assume the responsibility of providing or procuring counseling for individuals, when large sums of money accrue to that person, and to assist the person in protecting such funds. All money sent to the person served will be for the individual's use alone.

28. All persons served have the right to be presumed competent and to due process in
guardianship proceedings and fairly compensated for labor.

29. All persons served shall have to right to be protected from exploitation and abuse on the basis of their disability.

30. All persons served shall be assigned to private or multiple-use sleeping quarters without regard to race, color or national origin.

31. The individual or their legal representative will have the right to learn of any planned research. They, or the person legally authorized to act for them, has the right to determine whether or not that person will take part in the proposed research. The individual's right to privacy and confidentiality shall not be compromised.

32. All person's served have the right to receive a prompt transfer to an appropriate facility at such time as changes occur in an individual, medically or physically, that cannot be treated in this facility. Except in an emergency, the person served and/or parent or guardian, attending physician, and responsible agency shall be informed no less five days in advance of transfer.

33. BAC recognizes the fact that all persons have the right to individual religious experiences; the right to worship or not worship remains the responsibility of the parent and/or guardian.

34. For persons served of school age being contracted by a school district, BAC will follow the procedure for assuring the school district that all procedural safeguards afforded the student by the school district will fully be maintained during the period of the student's placement in the facility as per the Policies and Administrative Procedures for the Education of Handicapped Students, 35.74.010 (4) (E), Page 100.
